1. Agreement

These Terms of Service ("Terms") govern your use of vesperhauslighting.com (the "Site") and any purchase you make from us.

Vesperhaus is a trade name of Alassal Commerce, a sole proprietorship located at 8855 Balboa Ave, Suite C, San Diego, CA 92123, United States ("Vesperhaus," "we," "us," "our").

By using this Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from us. We currently sell and ship only within the United States.

3. Products

Descriptions. We describe our products as accurately as we can, including dimensions, materials, and battery specifications. We do not warrant that every description, image, or specification is error-free.

Color and light. Product photographs are representative. Actual finishes and light color temperature may appear different depending on your screen, your room, and the surrounding light.

Battery runtime. Stated battery runtimes are manufacturer estimates measured under specific conditions, typically at lower brightness settings. Actual runtime varies with brightness level, color temperature, ambient temperature, battery age, and charging habits.

Availability. Products are subject to availability. We may limit quantities, discontinue products, or decline sales at our discretion.

4. Pricing and Errors

Prices are in US dollars and subject to change without notice.

Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. We reserve the right to cancel or refuse any order placed at an incorrect price, including orders already confirmed or charged. If we cancel an order for this reason, we will refund you in full.

5. Orders

Your order is an offer to buy. We may accept or decline any order for any lawful reason, including suspected fraud, unauthorized resale, or listing errors.

An order confirmation email means we received your order — not that we accepted it. Acceptance occurs when we ship.

6. Payment

We accept the payment methods shown at checkout. You represent that you are authorized to use the payment method you provide. Applicable California sales tax is calculated at checkout.

7. Shipping and Risk of Loss

Shipping terms, processing times, and delivery estimates are described in our Shipping Policy, which is incorporated into these Terms by reference.

Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you upon the carrier's delivery to the address you provided.

8. Returns

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

9. Product Safety and Intended Use

Our products are lighting and decor items intended for ordinary consumer and commercial hospitality use as described on each product page.

You agree to:

Use each product only for its stated purpose and in its rated environment (indoor vs. outdoor, per the IP rating listed on the product page)
Follow the manufacturer's charging, battery, and care instructions included with the product
Not modify, disassemble, or repair the product, and not replace batteries with cells the manufacturer has not approved
Keep products away from water unless rated for wet locations, and away from flammable materials

Our products are portable, battery-powered fixtures. They are not hardwired electrical installations and are not a substitute for permanent lighting installed by a licensed electrician. We do not provide electrical, safety, or building-code advice.

10. Disclaimer of Warranties

Except where prohibited by law, and except for any manufacturer warranty accompanying a product, the Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Vesperhaus and Alassal Commerce will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of the Site or any product.

To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or any product will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Vesperhaus, Alassal Commerce, and its owner from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of a product, or your violation of any law or third-party right.

13. Intellectual Property

The Site — including its text, layout, graphics, logos, and the Vesperhaus name and branding — is our property or is used with permission, and is protected by intellectual property law. You may not copy, reproduce, or use it without our written permission.

Product images and specifications supplied by manufacturers remain the property of their respective owners.

14. Reviews and Submissions

If you submit a review, photo, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, and reproduce it in connection with our business. You represent that you own the content and that it is not unlawful, defamatory, or infringing.

We may edit or remove any submission at our discretion.

15. Prohibited Uses

You may not use the Site to violate any law, infringe any right, transmit malware, scrape or harvest data, interfere with the Site's operation, or purchase for unauthorized resale.

16. Third-Party Links and Services

The Site may contain links to third-party sites and relies on third-party services, including Shopify for hosting and payment processing. We are not responsible for third-party content, policies, or practices.

17. Termination

We may terminate or suspend your access to the Site at any time, without notice, for any reason, including breach of these Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.

Any dispute arising out of these Terms or your purchase will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of those courts.

19. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with a new "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance.

20. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Shipping Policy, Return & Refund Policy, and Privacy Policy, constitute the entire agreement between you and us regarding the Site and your purchases.
